Recently, the firm has been significantly involved in the representation of clients developing terminal facilities equipped to receive crude by rail, including all of the required permitting. Finally, the firm represents clients with respect to the permits required for developing terminal facilities to and other such transportation related infrastructure projects.

RAILROADS

Van Ness Feldman specializes in the representation of U.S. freight railroad customers and other entities who deal with the railroads in commercial contract matters, negotiations, arbitration, and litigation before the Surface Transportation Board in Washington D.C. and in federal courts where railroad contracts are in dispute. The firm also represents a number of industry associations on federal regulation, legislation, and policy development relating to the freight railroad industry’s exercise of market power.

Rail Merger Proceedings

Van Ness Feldman attorneys have experience representing clients in rail merger proceedings dating back to the 1990s. Representations have included successful outcomes in the Conrail acquisition proceeding, the Western Shippers Coalition in the Union Pacific-Southern Pacific merger proceeding, and the Canadian National-Illinois Central merger.

National Corn Growers Association

The firm represented the National Corn Growers Association in opposing the inclusion of an $8.2 billion acquisition premium, paid by Berkshire Hathaway Company for BNSF Railway Company, into the costs (for regulatory purposes) and investment base of BNSF Railway Company.

“Coal Dust” Tariff Dispute

The firm assisted the American Public Power Association, Edison Electric Association and the National Rural Electric Cooperative Association in preventing immediate enforcement of a tariff of BNSF Railway pertaining to “coal dust” from loaded coal trains in the Powder River Basin in Wyoming and Montana.
