Van Ness Feldman invites you to participate in a webinar on the future of EPA regulation of greenhouse gases under the Clean Air Act, presented and moderated by members of our Climate Change practice group, Kyle Danish, Stephen Fotis, and Lisa Epifani.

With near-term prospects for Congressional action on climate change fading, the Environmental Protection Agency (EPA) will be the central arena for federal climate change policy in the coming years. EPA regulation of greenhouse gases (GHG) and other regulatory initiatives raises new critical and complex questions for the power sector, resource developers, manufacturers, and other stakeholders:

• What are the principal authorities EPA will exercise over the near term?
• How will EPA action affect operations of existing facilities as well as investment in and permitting of new or modified facilities?
• Can EPA regulate GHGs and other pollutants using market-based approaches?
• How will ongoing litigation and possible Congressional developments affect EPA authority?

The speakers will address these subjects and entertain questions from webinar participants, with a focus on the following issues:

• The future of Prevention of Significant Deterioration (PSD) permitting for new and modified greenhouse gas-emitting facilities under the new "Tailoring Rule";
• Potential standard-setting for new and existing facilities under the New Source Performance Standards (NSPS) program, including the prospects for adoption of innovative market-based approaches; and
• Other developments that are anticipated to affect greenhouse gas regulation under the Clean Air Act, including other pending rulemakings for conventional pollutants; litigation over the Tailoring Rule, the endangerment finding, and other EPA decisions; and potential Congressional actions to limit or suspend EPA authority over greenhouse gases
